What you are asking for: A criminal investigation into whether DOGE staff broke your state’s computer crime and identity theft laws in handling the Social Security records of people in your state.
What that is: On January 16, 2026, the Justice Department told a federal judge that DOGE staff at the Social Security Administration shared agency data through Cloudflare, outside the agency’s security protocols. It also said the agency cannot determine what data left or whether copies still exist. Anyone whose record was in that data is a potential victim, and every person issued a Social Security number has a record with the agency. All 50 states have computer crime laws, and every state has an identity theft law. Federal officers are immune from state prosecution only when federal law authorized the act and the officer did no more than what was necessary and proper, under the Supreme Court’s 1890 test in In re Neagle. When conduct fails that test and breaks state law, the state can prosecute it, whatever federal prosecutors decide.
